Agreement
By using Encapsoul's website and services, you agree to these terms. If you do not agree, please do not use our services. We may update these terms from time to time and will notify you of material changes.
Service Description
Encapsoul is a memorial preservation platform. Families initiate a memorial project by providing information about a loved one and a list of contributors. We contact those contributors via SMS to collect memories, stories, and photos. We then compile those contributions into a permanent memorial artifact — a permanent digital archive and museum-quality hardcover memorial book.
Deposits and Payments
- A memorial project is initiated in one of two ways: a $2,500 payment for the all-inclusive Signature Memorial Experience, or a $500 payment to begin The Memory Collection, with an optional $1,500 payment for heirloom narration and design ($2,000 total).
- The Signature payment covers SMS collection, editorial curation, the printed heirloom, and your digital vault. The $500 payment covers SMS collection, memory curation, and 3 months of digital vault access; ongoing vault access after that period is $9.99/month or $999 for lifetime access.
- Contributors may optionally purchase tributes (a name listing or personal note) or additional copies of the finished book. These purchases are optional and never affect what the family receives.
- All payments are processed securely by Stripe.
- When you purchase through a funeral home partner, your payment may be collected by the funeral home rather than by Encapsoul directly. Encapsoul's obligations to you are identical either way.
Returns & Refund Policy
We want every family to feel confident choosing Encapsoul. That starts with a simple, honest refund policy.
Signature Memorial Experience ($2,500): 14-Day No-Questions-Asked Refund
Within 14 days of your $2,500 payment — whether you purchased directly or through a funeral home partner — you may request a full refund for any reason. No questions asked. Simply contact us at austin@encapsoul.life and we will process your refund within 5–10 business days to the original payment method. After the 14-day window, the payment is non-refundable: by this point, editorial work and SMS outreach to contributors will have begun, and resources have been committed to your memorial project.
The Memory Collection ($500): Deliverable Guarantee
The $500 payment always produces a deliverable: a digital Memory Archive of everything shared. If contributions are thin, we will extend the collection window and grant a $500 credit toward the heirloom design step that never expires. If no memories are received within the collection window, we refund the full $500.
Custom Memorial Books
Each memorial book is a one-of-a-kind, custom-created artifact built from the memories and photographs unique to your loved one. Because of this, printed books cannot be returned or refunded. If your book arrives damaged or with a printing defect, contact us immediately and we will reprint it at no cost.
Contributor Purchases
Tribute purchases made by contributors (name listings, personal notes, or additional copies) are non-refundable once the memorial has been delivered.
How to Request a Refund
Email austin@encapsoul.life with your name and the memorial project name. That's it. No forms, no justification required. If you're within the 14-day window, we process it immediately.
Production, Shipping & Delivery
- Memory collection runs for 14 days from the start of SMS outreach.
- Editorial production typically takes 4–6 weeks after the collection window closes, or 2–3 weeks with the priority option.
- The finished book ships to the address the organizing family member provides.
- All timelines are good-faith estimates, not guarantees. We will keep you informed if your project needs more time.
- Risk of loss passes to you on delivery.
- If your book arrives damaged or with a printing defect, we will reprint it at no cost, as described in our Returns & Refund Policy above.
Content Ownership
- Families and contributors retain ownership of all memories, stories, and photos submitted to Encapsoul.
- By submitting content, contributors grant Encapsoul a license to compile, edit, and publish that content within the memorial project. This license includes the right to sublicense to our service providers (such as printing and processing partners) solely as needed to produce and deliver the memorial.
- This license also lets us use your content to operate, evaluate, and improve Encapsoul — including developing the editorial AI that powers the service. We will not use your content for marketing without explicit permission, and we will not sell it or provide it to other companies to train their own general-purpose AI.
- Families may request removal of any contributor's content from the memorial at any time prior to printing.
SMS Consent
When a family lists contributors, those individuals will receive SMS messages from Encapsoul inviting them to share a memory. By providing contributor phone numbers, the organizing family represents that they have a personal relationship with each individual and that contact is appropriate in the context of the memorial.
Contributors can opt out at any time by replying STOP. Message and data rates may apply. Collection-related messages are limited: contributors receive no more than five collection-related messages per memorial project.
Separately, contributors and family members who opt in may receive ongoing remembrance messages — such as anniversary and “On This Day” remembrances — which they can stop at any time by replying STOP.

- Memorial tribute notifications and, for those who opt in, anniversary remembrances
- Collection-related message frequency varies by project, typically 2–5 messages per memorial; opt-in remembrance messages are ongoing until you reply STOP

- Carrier is not liable for delayed or undelivered messages
AI-Assisted Editing
Encapsoul uses AI tools to assist with organizing and structuring memorial content. AI-generated drafts are always reviewed by human editors and approved by the family before publication. We disclose this because transparency is a core value.
Acceptable Use
You agree not to:
- Submit content that is false, defamatory, or violates another person's rights
- Use the service for any purpose other than creating a genuine memorial
- Provide phone numbers of individuals without a legitimate personal connection
- Attempt to circumvent payment or security systems
Limitation of Liability
Encapsoul provides memorial services on an “as is” basis. While we strive for the highest quality, we cannot guarantee that every contributor will respond or that every memorial will receive a specific number of contributions. Our liability is limited to the amount you have paid for the service.
Governing Law
These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Travis County, Texas.
