Agreement
By using Encapsoul's website and services, you agree to these terms. If you do not agree, please do not use our services. We may update these terms from time to time and will notify you of material changes.
Service Description
Encapsoul is a community-funded memorial platform. Families initiate a memorial project by providing information about a loved one and a list of contributors. We contact those contributors via SMS to collect memories, stories, and photos. We then compile those contributions into a permanent memorial artifact — a digital archive, printed magazine, or hardcover book — depending on the level of community funding.
Deposits and Payments
- A $250 deposit is required to initiate a memorial project.
- The deposit covers SMS collection, editorial review, and your digital vault.
- Contributors may optionally purchase tributes (name listing, personal note, or book pre-order) that fund higher-tier deliverables.
- All payments are processed securely by Stripe.
Refund Policy
We offer a full refund of your $250 deposit within 14 days of payment, no questions asked. After 14 days, deposits are non-refundable, as editorial work and SMS outreach will have begun. Contributor purchases are non-refundable once the memorial has been delivered.
Content Ownership
- Families and contributors retain ownership of all memories, stories, and photos submitted to Encapsoul.
- By submitting content, contributors grant Encapsoul a license to compile, edit, and publish that content within the memorial project.
- This license is limited to the memorial project and related materials. We will not use your content for marketing without explicit permission.
- Families may request removal of any contributor's content from the memorial at any time prior to printing.
SMS Consent
When a family lists contributors, those individuals will receive SMS messages from Encapsoul inviting them to share a memory. By providing contributor phone numbers, the organizing family represents that they have a personal relationship with each individual and that contact is appropriate in the context of the memorial.
Contributors can opt out at any time by replying STOP. Message and data rates may apply. Message frequency varies but does not exceed five messages per memorial project.
AI-Assisted Editing
Encapsoul uses AI tools to assist with organizing and structuring memorial content. AI-generated drafts are always reviewed by human editors and approved by the family before publication. We disclose this because transparency is a core value.
Acceptable Use
You agree not to:
- Submit content that is false, defamatory, or violates another person's rights
- Use the service for any purpose other than creating a genuine memorial
- Provide phone numbers of individuals without a legitimate personal connection
- Attempt to circumvent payment or security systems
Limitation of Liability
Encapsoul provides memorial services on an “as is” basis. While we strive for the highest quality, we cannot guarantee that every contributor will respond or that every memorial will reach a specific funding tier. Our liability is limited to the amount you have paid for the service.
Governing Law
These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Travis County, Texas.
